NY Passes Marriage Equality Law

ALBANY—New York lawmakers narrowly voted to legalize same-sex marriage Friday, handing activists a breakthrough victory in the state where the gay rights movement was born.

New York will become the sixth state where gay couples can wed and the biggest by far.

Gay rights advocates are hoping the vote will galvanize the movement around the country and help it regain momentum after an almost identical bill was defeated here in 2009 and similar measures failed in 2010 in New Jersey and this year in Maryland and Rhode Island. Read more »

NY Court Recognizes Equal Spousal Rights for Same-Sex Couples

NEW YORK—A state appeals court has cleared the way for a same-sex spouse to inherit the estate of his deceased partner.

The Appellate Division, First Department, held yesterday in Matter of the Estate of H. Kenneth Ranftle, that recognizing the marriage in Canada of H. Kenneth Ranftle and J. Craig Leiby, who was designated as Mr. Ranftle's surviving spouse and sole distributee, did not violate public policy. Read more »

ACLU Files DOMA Challenge in NY

NEW YORK—Edith Edie Windsor, who shared her life with her late spouse, Thea Spyer, for 44 years, will file a lawsuit against the federal government tomorrow for refusing to recognize their marriage. The lawsuit challenges the constitutionality of the Defense of Marriage Act (DOMA), a federal statute that defines marriage for all federal purposes as a legal union between one man and one woman as husband and wife. Windsor and Spyer were married in Canada in 2007, and were considered married by their home state of New York. Read more »
