An Act concerning advance directives and supplementing Title 2A of the New Jersey Statutes and Title 26 of the Revised Statutes.
In many cases, the spouse or domestic partner is given authority in an advance directive, commonly referred to as a living will, to make decisions concerning the medical treatment of their partner. This bill would require judges in divorce and in termination of domestic partnership actions to inquire of all parties involved in such actions whether the divorce or termination of the domestic partnership would also require a change or revocation of any existing advance directive.
The sponsor believes this requirement may help avert difficult situations as those posed by the recent Schiavo case in the future.
